Terms of Services

Property Management Agreement & Service Conditions Effective Date: January 24, 2026

1. Introduction and Acceptance of Terms

Welcome to Tennyson Realty Inc. ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our property management services, website, online platforms, and any related services we provide (collectively, the "Services").

By engaging Tennyson Realty Inc. as your property manager, accessing our website, signing a management agreement, or otherwise using our Services, you ("Client," "Owner," "Tenant," or "User") agree to be bound by these Terms. If you do not agree to these Terms, please discontinue use of our Services immediately.

These Terms constitute a legally binding agreement between you and Tennyson Realty Inc. and are subject to change at our discretion with appropriate notice.

2. Scope of Property Management Services

Tennyson Realty Inc. provides a comprehensive suite of property management services, which may include but are not limited to:

  • Marketing and advertising of available rental properties

  • Tenant screening, selection, and lease execution

  • Rent collection and financial reporting

  • Property maintenance coordination and oversight

  • Periodic property inspections

  • Vendor and contractor management

  • Compliance with applicable local, state, and federal housing laws

  • Eviction proceedings and legal coordination when necessary

The specific scope of services provided to each Client will be outlined in a separate, signed Property Management Agreement. In the event of any conflict between these Terms and the Property Management Agreement, the Property Management Agreement shall control.

3. Fees, Compensation, and Payment Terms

Tennyson Realty Inc. charges fees for its services as detailed in the applicable Property Management Agreement. General fee provisions include:

  • Management Fee: A monthly fee, typically calculated as a percentage of collected rent, as specified in the Property Management Agreement.

  • Leasing Fee: A one-time fee charged upon the successful placement of a new tenant.

  • Maintenance Coordination Fee: Fees may apply for coordinating repairs and maintenance above a pre-agreed threshold.

  • Vacancy Fee: Fees may apply during vacant periods as outlined in the Agreement.

  • Eviction Fee: Additional fees apply for eviction-related legal and administrative services.

All fees are subject to applicable taxes. Tennyson Realty Inc. reserves the right to adjust fees upon thirty (30) days written notice to the Client.

4. Client and Owner Obligations

Property owners engaging Tennyson Realty Inc. agree to the following obligations:

  • Provide accurate and complete information regarding the property, including known defects, legal encumbrances, and HOA requirements.

  • Maintain adequate property insurance, including landlord liability coverage, at all times during the management engagement.

  • Fund a reserve account as specified in the Property Management Agreement to cover routine maintenance and emergency repairs.

  • Comply with all applicable local, state, and federal laws governing rental properties, including fair housing laws.

  • Promptly notify Tennyson Realty Inc. of any changes to ownership, financing, or legal status of the property.

  • Refrain from directly contacting or negotiating with tenants regarding matters delegated to Tennyson Realty Inc.

5. Tenant Responsibilities and Conduct

Tenants residing in properties managed by Tennyson Realty Inc. are subject to the terms of their individual Lease Agreement as well as the following general conditions:

  • Rent must be paid in full and on time as specified in the Lease Agreement.

  • Tenants must maintain the property in a clean, safe, and habitable condition.

  • Tenants must promptly report maintenance issues, damage, or safety hazards to Tennyson Realty Inc.

  • Unauthorized alterations, subletting, or assignment of the lease are strictly prohibited without prior written consent.

  • Tenants must comply with all applicable local ordinances, HOA rules, and community policies.

  • Vacating tenants must provide proper notice as specified in their Lease Agreement and leave the property in its original condition, reasonable wear and tear excepted.

6. Maintenance, Repairs, and Emergency Services

Tennyson Realty Inc. will coordinate routine and emergency maintenance on behalf of property owners subject to the following:

  • Routine maintenance requests will be addressed within a commercially reasonable timeframe.

  • Emergency repairs posing an immediate threat to health or safety will be addressed on a priority basis.

  • Tennyson Realty Inc. reserves the right to authorize repairs up to the pre-approved threshold stated in the Property Management Agreement without additional owner approval.

  • Repair costs will be deducted from the owner's reserve account or collected rent proceeds, with full accounting provided.

Tennyson Realty Inc. is not responsible for damages arising from deferred maintenance, pre-existing conditions, or owner-caused delays in authorizing necessary repairs.

7. Limitation of Liability and Indemnification

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TENNYSON REALTY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall Tennyson Realty Inc.'s total liability to any Client or Tenant exceed the total management fees paid by such Client during the six (6) months preceding the claim.

Client agrees to indemnify, defend, and hold harmless Tennyson Realty Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of the Client's ownership of the property, breach of these Terms, or violation of applicable law.

8. Privacy and Data Protection

Tennyson Realty Inc. collects, stores, and uses personal information in connection with the provision of its Services. By using our Services, you consent to our collection and use of your personal data as described herein and in our Privacy Policy.

We implement reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, disclosure, or misuse. We do not sell or rent personal information to third parties.

Personal information may be shared with authorized third parties including maintenance vendors, legal counsel, and financial institutions solely as necessary to provide the Services.

9. Term, Termination, and Transition

The term of the management engagement shall be as specified in the Property Management Agreement. Either party may terminate the Agreement as follows:

  • Owner Termination: Owners may terminate with thirty (30) to ninety (90) days written notice, as specified in the Agreement. Early termination fees may apply.

  • Tennyson Realty Inc. Termination: We reserve the right to terminate the engagement with thirty (30) days notice for any reason, or immediately in cases of material breach, fraud, or illegal activity.

Upon termination, Tennyson Realty Inc. will provide all tenant information, lease documents, accounting records, keys, and security deposits in an orderly transition to the owner or successor manager within fifteen (15) business days.

10. Dispute Resolution and Governing Law

In the event of any dispute arising out of or relating to these Terms or the Services, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, the parties agree to submit the matter to binding arbitration in accordance with the rules of the American Arbitration Association.

These Terms shall be governed by and construed in accordance with the laws of the State in which the managed property is located, without regard to conflict of law principles.

11. Fair Housing and Non-Discrimination Policy

Tennyson Realty Inc. is committed to full compliance with the Fair Housing Act and all applicable federal, state, and local fair housing and anti-discrimination laws. We do not discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, or any other protected class.

All clients, tenants, and applicants are entitled to equal and professional service. Tennyson Realty Inc. will not act on instructions from any property owner that would violate fair housing laws.

12. Modifications to These Terms

Tennyson Realty Inc. reserves the right to modify these Terms at any time. Changes will be communicated by written or electronic notice at least thirty (30) days before taking effect. Continued use of our Services after the effective date of any modifications constitutes acceptance of the updated Terms.
